Terms of Service - The Patchwork Calendar

1) Who we are

These Terms of Service (“Terms”) apply to purchases and use of products offered on thepatchworkcalendar.com (the “Site”), operated by Nicole Donna Vaughan (ABN 99 123 735 135), PO Box 99, Greenwood WA 6924, Australia (“we”, “us”, “our”).

By accessing the Site, placing an order, or downloading any digital content, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Refunds & Returns Policy (the “Policies”).

Nothing in these Terms limits your non-excludable rights under the Australian Consumer Law (ACL) or other applicable consumer laws.

2) Products and availability

  • The Patchwork Calendar is a combined product: (a) a printed wall calendar produced on demand and shipped to you; and (b) downloadable PDF quilt patterns delivered by email/download link.

  • We may update, limit quantities of, or discontinue products at any time.

  • Colours, paper stock, and finishes may appear differently on different screens/devices.

3) Pricing, currency and payment

  • Prices are shown in AUD unless stated otherwise.

  • GST (10%) is collected at checkout for Australian customers. Other taxes/fees may be collected where required by law.

  • Shipping and any additional fees are calculated at checkout.

  • We accept the payment methods shown at checkout and use third-party processors. By paying, you authorise us (and our processors) to charge your selected method for the total amount.

4) Orders, fulfilment and delivery

  • Digital patterns: Links are sent to your checkout email shortly after purchase. See Section 7 (Digital Content Licence).

  • Printed calendars: Produced after you order (print-on-demand) and shipped to your address. See our Shipping Policy for timelines and tracking.

  • Risk of loss transfers on delivery to the address you provide. Please check your address carefully.

5) Returns, refunds and cancellations

  • See our Refunds & Returns Policy for full details.

  • Printed calendars are made to order; change-of-mind returns aren’t accepted. We’ll remedy defects or transit damage (contact us within 7 days of delivery).

  • PDFs are non-refundable once delivered.

  • EU/UK: Starting a download may waive the 14-day withdrawal right, where permitted by law.

  • If you need to cancel or amend an order, contact us as soon as possible; changes may not be possible once production/shipping has begun.

6) Promotions and discount codes

  • Time-limited; subject to their own terms.

  • One code per order unless stated otherwise.

  • If an order is cancelled/refunded in part, promotional value may be adjusted.

7) Licence to use digital patterns (PDFs)

You receive a personal, non-transferable, non-exclusive licence to download and use the files for your own household, subject to these restrictions:
You may: print for personal use; make items for personal use/gifting; keep a personal backup.
You may not (without written permission): share, resell, sublicense, upload or distribute the PDFs; reproduce/translate/adapt the patterns for sale/publication; use them for mass manufacturing, factory production, or commercial kitting/teaching.

Commercial use note: Permissions for selling handmade items are defined in each individual PDF pattern’s licence section. If there is a conflict, the pattern-specific licence prevails for that pattern.
For classroom, guild, shop, or kit licences contact individual designers.

8) Intellectual property

All Site content (patterns, text, images, videos, graphics, logos, packaging) is owned by us or our licensors and protected by law. No rights are granted except those in Section 7.

9) User content (reviews, photos, submissions)

By submitting content, you grant us a worldwide, royalty-free, non-exclusive licence to use/display it for marketing in any media, with or without attribution (unless you notify us in writing not to use your handle/name). You must own the content and not infringe others’ rights.

10) Acceptable use

You agree not to violate laws; interfere with or attempt unauthorised access to the Site; scrape or automate downloads; misrepresent your identity; or infringe IP/privacy rights.

11) Third-party services and links

We use third-party providers (e.g., payments, production, shipping). Their terms and privacy policies apply; we aren’t responsible for third-party sites/services.

12) Warranties, consumer guarantees and liability

  • The Site and products are provided “as is”, subject to non-excludable consumer guarantees (e.g., ACL).

  • To the maximum extent permitted, our liability is limited to: (i) re-supply of goods/services, or (ii) the cost of re-supply.

  • We aren’t liable for indirect/consequential losses, lost profits, or delays outside our control (customs, carrier disruptions, force majeure).

13) Privacy

Handled per our Privacy Policy, which forms part of these Terms.

14) Governing law and disputes

Laws of Western Australia apply; WA courts have non-exclusive jurisdiction. Contact us first and we’ll try to resolve issues quickly.

15) Changes to these Terms

We may update these Terms by posting a new version on the Site. The updated Terms apply to orders placed after the “Last updated” date.

Refunds & Returns Policy — The Patchwork Calendar

Overview

We want you to love your calendar and patterns. This policy explains when refunds/reprints apply for printed calendars and PDF patterns. It should be read with our Shipping Policy and Terms of Service.

Your rights under the Australian Consumer Law (ACL) and other non-excludable laws apply in addition to this policy.

Printed calendars (made to order)

  • Change of mind: Because calendars are print-on-demand, we can’t accept change-of-mind returns or exchanges.

  • Defects or transit damage: We’ll reprint and reship or refund the affected item(s). Email hello@thepatchworkcalendar.com within 7 days of delivery with your order number, a description of the issue, and clear photos of the packaging and product.

  • Wrong address/undeliverable: If a parcel returns due to an incorrect or incomplete address, re-shipping fees may apply.

  • Lost parcels: Contact us within 14 days of the last tracking scan or expected delivery date; we’ll investigate with the carrier and arrange a suitable remedy if the parcel is confirmed lost.

  • Do not return items without authorisation. We’ll provide instructions if a return is required.

PDF patterns (digital downloads)

  • All sales final: Non-refundable once delivered (including accidental purchases or compatibility issues).

  • EU/UK digital purchases: By starting the download, you consent to immediate supply of digital content and acknowledge that the 14-day withdrawal right may not apply where permitted by law.

  • Access issues: If your download link doesn’t arrive or won’t open, contact us and we’ll help restore access.

How refunds/reprints are processed

  • Approval: Once we verify eligibility, we’ll confirm by email.

  • Remedy: For printed items, we usually reprint/reship. In some cases we may refund instead.

  • Refund method: Original payment method only. Processing by your bank can take 5–10 business days after we issue the refund.

  • Partial refunds/adjustments: If only part of an order is affected, we may issue a partial refund or replacement for the affected item(s).

Proofs and colour variation

Small variations in colour and trimming can occur in print processes and across devices/screens. These normal tolerances aren’t considered defects. Significant print errors or damage will, of course, be remedied.
